These Terms and Conditions govern your use of our website and our professional services regarding the sale, purchase, and brokerage of commercial printing, offset, and bindery equipment. By accessing this website or entering into a business transaction with us, you agree to comply with and be bound by these terms.
1. Nature of Business & Machinery Condition
Rex Machinery specializes in the sale and purchase of industrial pre-owned and new printing and bindery equipment. Unless explicitly stated otherwise in writing:
- All used or pre-owned machinery is sold on an “As-Is, Where-Is” basis, with all faults and without any structural, mechanical, or electrical warranties.
- Buyers are strongly encouraged and given full opportunity to thoroughly inspect the machinery, run trials, and verify specifications before final execution of the purchase.
- Descriptions, photographs, and video demonstrations provided on the website or via correspondence are for general identification purposes only and do not constitute a binding guarantee of condition.
2. Pricing, Quotations, and Taxes
- All price quotes provided by Rex Machinery are competitive and valid only for the period specified in the formal quotation sheet.
- Unless specified otherwise, prices do not include statutory local taxes (e.g., GST), import/export duties, dismantling fees, custom clearance, rigging, loading, or transportation costs. These extra expenses shall be entirely borne by the buyer.
3. Payment Terms & Order Confirmation
A machinery transaction is considered officially booked and confirmed only upon receipt of a mutually agreed advance token payment. The standard structure is as follows:
- An agreed initial advance deposit is mandatory to reserve the machine from active sale.
- The remaining balance payment must be cleared in full prior to dismantling, packing, or dispatch of the machinery from its current location.
- Failure to clear the final balance within the stipulated timeline will give Rex Machinery the absolute right to cancel the transaction and forfeit the advance payment to offset holding losses.
4. Logistics, Risk, and Delivery
Unless a clear turnkey contract is drafted, delivery terms default to Ex-Works (EXW):
- The transfer of risk, responsibility, and liability concerning the machinery shifts directly to the buyer as soon as the equipment leaves our designated warehouse or site.
- Rex Machinery is not legally liable for any damages, transit delays, structural losses, or accidents occurring during loading, transport, or unloading. Shipping insurance is strongly advised.
5. Intellectual Property Rights
All content, branding, original machinery photographs, unique descriptive listings, technical layouts, and logos appearing on www.rexmachinery.com are the exclusive intellectual property of Rex Machinery. Unauthorized duplication, modification, or redistribution of this media for competing commercial activities is strictly prohibited under copyright protection rules.
6. Limitation of Liability
Rex Machinery, its owners, or its representatives shall under no circumstances be held responsible for any consequential, incidental, indirect, or operational losses (including but not limited to business downtime, loss of printing contracts, production delays, or labor costs) arising out of the installation, operation, mechanical breakdown, or delayed delivery of the machinery.
7. Governing Law and Jurisdiction
Any legal disputes, differences, or contractual claims arising out of business transactions with Rex Machinery or through the use of this website shall be strictly governed by the laws of India and shall be subject to the exclusive jurisdiction of the competent courts in Delhi, India only.
